Hemp CBD oil presents a HUGE opportunity in Florida!

Floridians have much to gain by embracing the Green Rush, and especially the exploding popularity of hemp CBD oil in Florida.

Florida is prime real estate for the farming of hemp. The state has the potential to grow into one of the largest producers of CBD oil in the US. Furthermore, with one in five residents over the age of 65, the sunshine state has the highest percentage of senior citizens of any state. And with that population comes staggering medical bills.

However, CBD oil, which is now legal in Florida, shows great promise as a pain killer, sleep aid, antidepressant, anti anxiety, anti-inflammatory, antitumor, antiseizure, and possibly antidementia medicine among other things.

If even a percentage of the rumors are true, Floridians stand to save quite a bit of money on medical bills and pharmaceuticals while Florida hemp farmers flourish.

However, Floridians are not content to just hop on the bandwagon and follow the parade of hype surrounding CBD oil. In fact, a full 86 percent of Floridians believe the state should facilitate expanded research into the safety and efficacy of CBD products. That is according to a poll recently conducted by the consumer advocacy group National Consumers League. 

Answering the question of whether or not CBD oil is safe and effective is not going to be an easy proposition. The process has been ongoing for decades but has been stunted due to federal regulations.

2018 Federal Farm Bill, Hemp, CBD, & Marijuana Key Points

Hemp, on the other hand, is a different story. The “plant with 10,000 uses” has finally, as of December 20th, 2018, been legalized nationwide by language included in a recent farm appropriations bill. however with the passing of the 2018 Federal Farm Bill, hemp has become legal in the United states.

• Removed Hemp from the oversite of the DEA to the US Department of Agriculture (USDA)

• Established rules for states to submit plans to the USDA to establish their own hemp farming program consistent with the new Federal standards.

• Separated Hemp from Marijuana and defined hemp as containing less than .3% THC

• Removed Hemp & Hemp derived products such as CBD oil from the schedule I substance list (no medicinal value)

• Marijuana Plants and their extracts such as CBD Oil containing more than .3% THC remain on the Schedule I list and are subject to Federal Marijuana Laws.

It’s just the beginning for Florida’s hemp program

Now that hemp and CBD are legal in Florida, experts expect research to ramp up substantially. 

For example, Fort Lauderdale-based Green Point Research in partnership with Florida State University is planning to conduct a study into the benefits and effects of CBD oil. And the hemp used in the study will be grown at farms in North, Central and South Florida as part of a separate study on commercial hemp farming. 

The most important thing that researchers have learned so far is that CBD oil is complicated. It contains numerous active compounds the concentrations of which can vary greatly from crop to crop. Also, everyone reacts differently to these compounds. What might be the perfect formula for one person might bring on unwanted side effects in another. To do CBD right really requires that users do their homework. 

Furthermore, as of the time of writing, there are no regulations in place in Florida to assure the safety of CBD products. Because of this Florida Agriculture Commissioner and cannabis advocate Nikki Fried is urging Floridians to use caution when buying CBD products. She is also working with legislators on developing regulations that would standardize testing and labeling on CBD products.

Is CBD oil legal in Florida?

Technically, until the state’s hemp and CBD laws go into effect, the only Florida residents who are legally permitted to use CBD oil are those enrolled in the state’s medical-marijuana program. That is likely to change by the time you read this. 

Does it matter? Probably not. Thousands of shops in the state already sell CBD oil and other CBD products. However, there are instances of state officials attempting to enforce the laws. For example, back in May of 2019, a great-grandmother was arrested at Disney’s Magic Kingdom for possessing CBD oil. All charges were later dropped when attorneys filed a notice of intent to sue the Orange County Sheriff’s Office and Walt Disney World.

The situation changed in late June 2019, when Governor Ron DeSantis signed Senate Bill 1020. The measure officially legalized the cultivation of non-intoxicating strains of cannabis (aka hemp) as well as the production and sale of CBD oil produced from hemp going into effect in 2020. However, the rules have not been finalized as of the time of writing. 

Under the new laws, hemp-derived CBD products are expected to be legal for all Floridians — not just medical marijuana patients. Great grandmothers entering Disney World no longer need fear being arrested for drug possession.

Can doctors in Florida prescribe CBD oil?

In the state of Florida, doctors are not permitted to prescribe either hemp CBD oil or marijuana products to their patients. This is because marijuana is still federally illegal, and the US Food and Drug Administration has not approved hemp CBD for medicinal use. 

There is, however, one exception at this time. A drug called Epidiolex, which is essentially pure CBD, has been approved by the FDA for use by children suffering from certain intractable forms of epilepsy with a doctor’s prescription. 

Although marijuana doctors in Florida are not permitted to prescribe CBD oil as they are with pharmaceuticals, they are permitted to recommend CBD oil to patients they feel can benefit from its use.

What medical conditions are being treated with CBD oil in Florida?

Floridians are using CBD oil to treat a wide array of medical conditions. To qualify for marijuana-derived cannabis oil a patient must be diagnosed with one of a list of qualifying conditions. However, there are also additional conditions that are commonly treated with hemp CBD oil.

Florida Qualifying Conditions For Medical Marijuana:

In order to legally purchase CBD oil with THC via Florida’s medical marijuana program, you must have one of the medical issues on the list of qualifying conditions, show that you have tried other treatments that haven’t worked, and be approved by a certified physician.

Here’s a list of qualifying conditions:

To become a legal medical marijuana patient in Florida, you’ll need to obtain medical records from your primary care physician and make an appointment with a doctor that is certified by the state to determine your eligibility for a medical marijuana card.

Once you are approved for a medical marijuana card you’ll be registered with the Department of Health’s Office of Medical Marijuana Use and your application will be sent to the Florida Department of Health. The card itself will cost another $75.

Once the state of Florida has received your application and a check for $75 you’ll be issued a medical marijuana card and you’ll be able to legally purchase low-THC CBD oil — and high-THC cannabis oil for that matter. This process can take up to a month to complete. Although the card is good for a year, you need to be re-examined by a certified physician every 30 weeks, in order to renew.

Where Can I Buy CBD Oil In Florida?

If you’re want to purchase cannabis oil made from marijuana, you have to have a Florida medical marijuana card and purchase your medicine at a licensed dispensary.

If instead, you are shopping for CBD-rich hemp oil or other CBD-infused products you’ll find that the number of retail outlets that carry hemp CBD oil is growing daily. 

Most of the brick-and-mortar stores that sell CBD oil and other CBD products are located in the larger cities in Florida such as Miami, Tampa, Tallahassee, Jacksonville, St. Petersburg, Fort Lauderdale, and Orlando. However, hemp CBD products can also now be found in rural areas in the state. 

Be forewarned, however, that many of the products currently available on store shelves have not been tested for purity and potency. It’s important to do your homework before randomly purchasing CBD products.

Can I Buy Hemp CBD Oil Products Online In Florida?

Florida residents can easily purchase all kinds of CBD oil and other CBD products online and have them delivered right to their door.

Local shops might only carry a few brands, and these might not be the most trusted brands or highest-quality products. Can I Legally Grow Hemp In Florida?

Florida Governor, Ron DeSantis, signed Florida Senate Bill 1020 in June of 2019. The measure called for the Florida Department of Agriculture and Consumer Services to develop regulations for the cultivation of hemp and the production of CBD oil. The rules have been developed but have not yet been approved by the USDA.

Unfortunately, under the proposed rules, not just anyone in Florida can grow hemp. Only those licensed by the state are permitted to do so. And the licensing requirements will be stiff. Florida Cannabis Director Holly Bell expects something in the neighborhood of 8,000 applications for Florida hemp cultivation permits. However, she expects only about 3,000 farm operations to qualify.

As of the time of writing, the application process has not yet begun. Although the proposed rules were unveiled by the DOA, the state is still waiting for the USDA to review them before initiating the application process. Can I Legally Sell CBD Oil In Florida?

As of the time of writing, the rules regarding the retail sale of CBD oil in Florida are still in flux. Technically, until the ink has dried on the final rules, it is illegal to sell CBD oil and other CBD products in Florida. But that hasn’t stopped retailers from doing so.   • It is not very responsible to tell people that they can drink a bottle of CBD oil and not get high. CBD does have a great affect on your body and drinking a bottle of it would make you VERY VERY high – non psychoactive effect. The word high means nothing and the effect of CBD is active in the body and blood. While THC is active in the mind.

  • I found this information a very good and helpful explanation of what it will take and cost to get a very good, very effective pain cream. I have MS and I have a lot of neurological pain. I tried a friend CBD with THC pain cream and I was amazed at the results. I am traveling to Florida on vacation and was hoping to buy some, now I understand I need a card to purchase. With MS I meet the requirements but cannot afford the process. Hopefully with time the cost will go down.
